These Terms and Conditions (“Terms”) govern your use of the Drive Sales website at drivesales.com.au (the “Platform”), operated by Drive Sales (“we”, “us”, “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. About Drive Sales
Drive Sales is an online car marketplace that allows dealers and private individuals to list vehicles for sale, and allows buyers to browse and enquire about those vehicles. We are not a party to any transaction between buyers and sellers. We do not own, sell, or warrant any vehicle listed on the Platform. The Platform is currently free to use for all users.
2. Eligibility
● Be at least 18 years of age
● Be an individual using the Platform for personal purposes, or an authorised representative of a business
● Provide accurate and complete registration information
● Not be prohibited from using the Platform under applicable law
3. Account Registration
To create a listing or access certain features, you must register for an account. You agree to:
● Provide accurate, current, and complete information during registration
● Keep your account information updated
● Maintain the confidentiality of your password and account credentials
● Notify us immediately of any unauthorised use of your account
You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Email Communication
By creating an account on Drive Sales, you agree to receive emails from us. These emails may include account confirmations, listing notifications, enquiry alerts, platform updates, and marketing communications about our services. You can opt out of marketing emails at any time using the unsubscribe link, but you cannot opt out of transactional and account-related emails while your account remains active.
5. Listings
Users may create vehicle listings on the Platform. By submitting a listing, you represent and warrant that:
● You are the owner of the vehicle, or are authorised to sell it on behalf of the owner
● All information in the listing is accurate, complete, and not misleading
● The vehicle is legal to sell in Australia and complies with all applicable laws
● You hold clear title to the vehicle, or have disclosed any encumbrances (e.g. finance owing)
● Your listing does not infringe any third-party intellectual property rights
● All photos submitted are yours to use and accurately represent the vehicle
We reserve the right to remove any listing that we believe, in our sole discretion, violates these Terms, is misleading, fraudulent, or otherwise inappropriate, without notice or liability.
6. Prohibited Conduct
● Post false, misleading, or fraudulent listings
● List stolen vehicles or vehicles with outstanding finance that is not disclosed
● Impersonate any person or entity
● Harvest or scrape data from the Platform without our written consent
● Introduce malware, viruses, or other harmful code
● Engage in any conduct that could damage, disable, or impair the Platform
● Use the Platform for any unlawful purpose
● Spam, harass, or send unsolicited communications to other users
7. Buyer Responsibility
Drive Sales is a listing platform only. We strongly advise all buyers to:
● Conduct their own due diligence before purchasing any vehicle
● Inspect the vehicle in person or have it inspected by a qualified mechanic
● Conduct a PPSR (Personal Property Securities Register) check to confirm the vehicle has no encumbrances or stolen status
● Verify the seller’s identity
● Not pay any deposit or purchase price until you have satisfied yourself that the transaction is legitimate
Drive Sales takes no responsibility for the condition, legality, or ownership of any vehicle listed on the Platform.
8. Dealer Accounts
Dealers listing vehicles on the Platform represent that they hold all required licences and registrations to operate as a motor vehicle dealer in their state or territory. Dealers are responsible for ensuring their listings comply with the Australian Consumer Law and any applicable state-based motor vehicle dealer legislation.
9. Advertising
We currently do not display third-party advertising. We intend to offer advertising placements on the Platform in the future. When advertising is introduced, separate terms will apply to advertisers. Advertising on the Platform will be clearly labelled as such.
10. Intellectual Property
All content on the Platform created by Drive Sales — including our logo, design, text, and software — is owned by or licensed to us and is protected by Australian and international copyright law. You must not reproduce, distribute, or create derivative works from our content without our written permission.
By submitting content to the Platform (including photos and listing descriptions), you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content on the Platform and in our marketing materials for the purpose of operating the Platform. You retain ownership of your content.
11. Privacy
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Platform, you agree to our Privacy Policy.
12. Disclaimer of Warranties
The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses. We do not endorse, verify, or warrant the accuracy of any listing or the suitability of any vehicle for any purpose.
13. Limitation of Liability
Drive Sales and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any transaction facilitated through it, including but not limited to loss of money, loss of data, or personal injury arising from a vehicle purchase.
14. Indemnification
You agree to indemnify and hold harmless Drive Sales and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your listings, or your breach of these Terms.
15. Termination
Upon termination, your listings will be removed from the Platform. Provisions of these Terms that by their nature should survive termination will continue to apply.
16. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of New South Wales.
17. Changes to These Terms
We may update these Terms at any time. We will notify registered users of material changes via email and will post the updated Terms on this page with a revised date. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
